CMS has launched a new publication: Electronic Signatures & E-Signing Platforms – The definitive UK legal guide. 

It is designed to provide guidance on the law governing electronic execution of deeds and documents in all UK jurisdictions (the position in Scotland differing in many respects from the rest of the UK), and on the practicalities of engaging with e-signing platforms.   

Given the COVID-19 pandemic and associated social distancing rules and increase in home working, face-to-face signing of documents and deeds in wet-ink is no longer practical and poses a risk to public health. Thus the adoption of e-signing platforms has been accelerated. 

Many members will already be using the basic solutions on a daily basis, others are engaging significant exercises to implement platforms and update their policies and procedures to adapt to this new way of working.  All members are probably receiving requests from third parties to execute documents by electronic means – so CMS thought you could be interested to assess the associated risks. To accompany the guide, CMS has also concluded a series of three E-Signature webinars, which you can now catch up with on-demand here. The series takes an in-depth and practical look at how businesses can achieve efficiencies using these technologies, with guest speaker appearances from Dropbox’s commercial e-signing platform HelloSign, HM Land Registry and Adobe.
